1. Acceptance of Terms

By accessing or using Nimu ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

Nimu is an email outreach platform that enables users to create and manage multi-step email campaigns with built-in domain authentication, deliverability monitoring, and reputation-safe sending limits.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree not to use the Service to send unsolicited bulk email (spam), harvest email addresses without consent, send emails containing malware or phishing content, violate any applicable laws including CAN-SPAM, GDPR, or CASL, or impersonate any person or entity.

5. Sending Limits & Compliance

Nimu enforces sending limits and ramp-up controls to protect your domain reputation and ensure deliverability. You must not attempt to circumvent these limits. All emails sent through the Service must include a functional unsubscribe mechanism.

6. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of the data you upload or create through the Service. Nimu processes your data solely to provide the Service.

7. Termination

We may suspend or terminate your access to the Service at any time if you violate these terms, particularly the acceptable use policy. Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. Nimu shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to lost revenue, email deliverability issues, or domain reputation damage.

9. Changes to Terms

We reserve the right to modify these terms at any time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated terms.
